Every accident case is different but below is a general outline of the
course you can expect an accident claim will take.
-
You will contact your Attorney and he or she will take
information from you regarding your accident, your medical care
and your personal information.
-
Your Attorney will set up a file and make a claim with the
insurance company.
-
Your Attorney will collect all bills and lost wage information
related to your case to build your file.
-
When you have completed treating for your injuries, you will be
asked to provide information relating to any time you missed from
work including the dates, hours and rate of pay.
-
Your Attorney will combine your medical bills and lost wage
information with any other expenses you may have incurred as a
result of the accident and send this information to the insurance
companies. At this time he or she will also make a demand for
settlement.
-
You claim will be reviewed by the insurance company and if they
determine their driver is responsible for the accident and your
damages, they will decide on an amount of money to pay you to end
your claim.
-
Your Attorney will negotiate with the insurance company in an
effort to recover as much money for you as possible.
-
If an offer of settlement is made, your Attorney will
communicate the offer to you and you will have the decision of
whether to accept of deny the offer.
-
If a settlement is not reached your claim will be filed in the
appropriate court and a lawsuit will be commenced.
